Alternative Dispute Resolution ADR
Alternative Dispute Resolution (ADR) methods are methods for resolving disputes between parties, whether they are internal conflicts within a company or situations that are difficult to resolve out of court. The resolution of these conflicts can take place both at national and international level.
In the ADR department of Fuster-Fabra Abogados we have extensive knowledge of ADR and we provide you with the necessary advice to give you the best alternatives to solve your problems without having to go to court.
The most recognised techniques are negotiation, mediation and conciliation.
- Negotiation: This is based on gradually bringing positions closer together and with reciprocal concessions until an agreement is reached that sufficiently satisfies both parties.
- Mediation: a neutral and impartial third party, known as a mediator, helps them to communicate with each other and try to reach an agreed solution.
- Conciliation: the parties appear before a third party, usually a judicial or administrative body, which tries to bring them together to avoid litigation.
